Terms of service


1. Governing Terms. These Terms and Conditions of Sale (“Terms”) govern the sale by Semka, LLC (“Semka”) of its products to you. Semka offers to sell its products solely pursuant to these Terms and any acceptance is limited to these Terms.


2. Limited Warranty; Disclaimer. Semka warrants that the ingredients in its products will, to the best of Semka’s capabilities, conform to the information on the labels attached to such products. Semka makes no other warranty, express or implied,
including any warranty of merchantability or fitness for a particular purpose. Any information on Semka’s website and product labels are for reference purposes only and are not meant to be a substitute for, or replacement of, advice of a physician,
pharmacist, or other licensed healthcare professional. Semka’s products and the information on its website and product labels have not been evaluated by the Food and Drug Administration. Semka’s products are not intended to diagnose, treat, cure, or
prevent any disease, and Semka does not guaranty or warrant any particular result or outcome from the use of its products.


3. Shipping. Please note that shipping times of Semka’s products are generally not guaranteed. Once an order has been shipped, Semka is no longer responsible for how long an order takes to be delivered to you. There are many factors that can impact shipping timelines, including weather and deliverer errors.


4. Liability. Semka will not be liable for consequential, incidental, indirect, exemplary, or special damages, whether in an action based on contract, tort, or other legal theory, related to any products Semka sells to you. The sole liability of Semka for any claim related to any products it sell to you is limited exclusively, at the option of Semka, to replace the product or refund the purchase price of the product, subject to the returns/refunds policy set forth in Section 5.


5. Returns; Refunds. Any return requests for products must be submitted within 15 days of the date of purchase. To be eligible for a return, the product must be unused, unopened, and in the same condition that you received it, including in its original packaging. You must contact Semka’s customer service team to receive a return approval prior to returning any product. To complete your return, you must submit a receipt or proof of purchase. You will be responsible for paying for your own shipping costs for returning a product. The following items are not returnable: gift cards, sale items, or discontinued items. Once your returned product is received and inspected by Semka, Semka will send you an email to notify you that Semka has received your returned item. Semka will also notify you of the approval or rejection of your refund. If you are approved, your refund will be processed and a credit will be applied to your credit card or original method of payment. It may take some time before your refund is officially posted to your bank or credit card. If you have not received your refund within 15 days, please contact Semka’s customer service team.


6. Governing Law; Venue. The laws of the State of South Dakota will govern Semka’s sale of products and the performance and construction of these Terms. Any disputes regarding Semka’s products or these Terms will be resolved in the federal or state courts in or for Lincoln County, South Dakota.


7. Entire Agreement. These Terms, along with any purchase order accepted by Semka, constitute the entire agreement with regard to the sale and purchase of our products and supersede any prior or contemporaneous agreements relating thereto. These Terms may not be cancelled or amended except in a writing signed by Semka.
